This Privacy Policy explains how Emergix LLC, doing business as Agentic Foundry (“Agentic Foundry,” “we,” “us,” “our”) collects, uses, discloses and protects personal information when you visit our website at agenticfoundry.ai, subscribe to our newsletter, submit a contact form, request information or otherwise interact with us (collectively, the “Services”).
By using the Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Services.
1. What Personal Information We Collect
1.1 Information You Provide Directly
Depending on how you interact with us, we may collect newsletter subscription information, including your email address and optionally your name, company name, job title or expressed content preferences; contact and inquiry information, including your name, email address, company name, message contents and any other information you choose to provide; and business communications, meaning information you share during conversations about our services, potential partnerships or other opportunities. Much of the information we collect relates to individuals acting in a professional or business capacity, such as work email address, job title or company affiliation.
1.2 Information We Collect Automatically
When you visit our website or interact with our emails, we may automatically collect device and usage data, including IP address, browser type and version, device identifiers, pages viewed, referring URLs, approximate location derived from IP address at the city or state level and timestamps; cookie and tracking data collected through cookies, pixels and similar technologies that help us understand how the site is used and measure marketing effectiveness (see Section 5 for more detail); and email engagement data, such as whether an email we sent was delivered, opened or had links clicked. We may also use analytics providers such as Google Analytics or comparable services to understand how visitors interact with our website. We may also automatically collect publicly available company and brand information.
1.3 Information From Third Parties
We may receive information about you from third parties. Sales and marketing enrichment providers, such as Apollo, may supply us with publicly available business information like company name, job title or industry to help us understand our audience and conduct business-to-business outreach. CRM and marketing platforms, such as HubSpot, may collect and associate information with your contact record if you engage with our forms, landing pages or distributed content. We may also draw on public sources such as professional directories in connection with business-to-business marketing and outreach.
We treat all information received from third parties in accordance with this Privacy Policy.
2. How We Use Personal Information
We use personal information collected from all visitors and contacts to:
- Operate, maintain and improve our website and Services;
- Respond to your inquiries and communicate with you about your requests;
- Maintain security, prevent fraud and abuse and debug technical issues;
- Comply with our legal obligations and enforce our Terms of Use; and
- Conduct professional B2B outreach to relevant business professionals. We rely on our legitimate interest in making decision-makers aware of our AI solutions. You may opt out of such outreach at any time by contacting us at privacy@agenticfoundry.ai.
For newsletter subscribers, we additionally use your information to:
- Send newsletters, updates and other email communications you have requested or consented to receive;
- Understand and analyze how our content and emails are used; and
- Measure the performance of marketing campaigns and email communications.
For users of our agentic content marketing platform, we additionally use your information to:
- Provide agentic content generation services, including processing your inputs through AI models to generate marketing outputs;
- Facilitate automated content workflows on your behalf; and
- Develop and manage your account, billing and customer relationship.
3. How We Share Personal Information
Not all sub-processors listed below apply to all users. Sub-processors marked as applicable to platform users only are engaged solely in connection with our agentic content marketing services.
3.1 Service Providers and Sub-Processors
We share personal information with third-party vendors that perform services on our behalf, including:
- AI Model Providers (platform users only): To provide our core agentic content marketing services, your inputs are processed by third-party Large Language Model (LLM) providers such as OpenAI or Anthropic. Newsletter subscriber email addresses are not shared with AI Model Providers for the purpose of content generation.
- Marketing & CRM: Customer relationship management and analytics tools including HubSpot and Apollo.
- Email Delivery: Marketing automation and newsletter distribution via Brevo.
- Infrastructure: Website hosting, security and cloud infrastructure providers.
These service providers are authorized to use personal information only as necessary to provide services to us and are prohibited from using it for their own independent marketing purposes.
3.2 Legal, Safety and Rights Protection
We may disclose personal information if we believe in good faith that disclosure is necessary to comply with applicable law, a court order or a lawful request from a government authority; to protect the rights, property or safety of Agentic Foundry, our users or others; or to investigate or prevent fraud, abuse or security incidents.
3.3 Business Transfers
If we are involved in a merger, acquisition, financing, reorganization, bankruptcy or sale of all or a portion of our assets, personal information we hold may be transferred to the acquiring entity as part of that transaction. We will notify you of any such transfer and any material changes to how your information is used as required by applicable law.
3.4 With Your Direction
We may share personal information when you specifically request or consent to it.
4. Artificial Intelligence Processing
The following provisions apply primarily to users of our agentic content marketing services. Because our Services utilize generative AI, we maintain specific protections regarding your data:
4.1 Input and Output Processing: When you provide instructions, data, or “seeds” for content (“Input”), that data is transmitted to our AI models to generate your newsletters, blogs, or social media posts (“Output”).
4.2 Output Review Responsibility: Because generative AI systems can produce content that may be inaccurate, incomplete, or outdated, users remain responsible for reviewing and verifying any AI-generated outputs before publishing, distributing, or relying on them for business or marketing purposes. Agentic Foundry does not guarantee the accuracy, completeness, or suitability of AI-generated outputs.
4.3 No Global Training: We do not use your personal information, proprietary Input, or generated Output to train, retrain or improve our global machine learning models or those of our third-party LLM providers. Your unique brand voice and marketing strategies remain private to your account.
4.4 De-identified Metadata: We may use anonymized, aggregated metadata (such as the number of posts generated or feature latency) to improve the technical performance of our platform infrastructure, provided this data cannot be linked back to you or your specific content.
5. Cookies and Similar Technologies
We use cookies, pixels and similar tracking technologies to operate and secure the site; understand how visitors interact with the site; and measure the performance of marketing campaigns and content.
You can control or disable cookies through your browser settings. Please note that disabling certain cookies may affect the functionality of the Services.
Do Not Track: Some browsers transmit “Do Not Track” (DNT) signals to websites. While no uniform technical standard for responding to DNT signals has been established, we are committed to user choice and will update our practices if a recognized standard emerges.
Note on Identity Resolution: If you visit our website, we may work with third-party partners to associate your browsing activity with a professional email address for B2B outreach purposes. 6. Marketing Communications and Your Choices
6.1 Unsubscribing From Marketing Emails
When you subscribe to our newsletter, you consent to receive periodic marketing and informational emails from us. You can opt out at any time by clicking the unsubscribe link in any marketing email we send, or by contacting us at privacy@agenticfoundry.ai.
We will process opt-out requests promptly, no later than 10 business days after receipt. After unsubscribing, we may continue to send you non-marketing messages, such as replies to a direct inquiry, administrative notices or security-related communications.
6.2 Managing Platform-Specific Preferences
Our email delivery, CRM and outreach platforms (such as Brevo, HubSpot and Apollo) are used to maintain subscription status and suppression lists; measure engagement; and manage contact preferences. If you experience any difficulty unsubscribing, please contact us directly at privacy@agenticfoundry.ai and we will honor your request manually.
7. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes for which it was collected, including to provide the Services and communications you have requested; comply with legal obligations, resolve disputes and enforce our agreements; and maintain suppression lists to honor opt-out requests.
If you unsubscribe from our newsletter, we will remove you from active mailing lists and may retain a limited record of your email address on a suppression list to ensure we do not inadvertently contact you again. When personal information is no longer needed, we will delete or anonymize it in accordance with our internal retention practices.
8. Security
We use reasonable administrative, technical and organizational measures designed to protect personal information against unauthorized access, disclosure, alteration or destruction. However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security.
8.1 International Data Transfers
Your personal information may be transferred to and processed in countries other than the country in which you reside, including the United States, where our service providers and infrastructure are located. We rely on appropriate safeguards for such transfers, including Standard Contractual Clauses approved by the European Commission where required. 9. Children’s Privacy
The Services are not directed to children under the age of 18, and we do not knowingly collect personal information from children under 18. Our Services are intended solely for use by adults and business professionals. If you believe that a child under 18 has provided us with personal information, please contact us at privacy@agenticfoundry.ai and we will take appropriate steps to delete that information.
10. Your US Privacy Rights
10.1 General Rights
Depending on where you reside, you may have the right to request access to the personal information we hold about you; request correction of inaccurate or incomplete personal information; request deletion of certain personal information; and opt out of certain marketing activities or targeted advertising.
To exercise any of these rights, email us at privacy@agenticfoundry.ai with the subject line “Privacy Request” and describe your request. We may ask you to verify your identity before processing your request.
10.2 California Residents (CCPA/CPRA)
If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), including the right to know what personal information we collect, use, disclose and share; the right to delete personal information we hold about you, subject to certain exceptions; the right to correct inaccurate personal information; the right to opt out of the sale or sharing of your personal information; the right to limit the use of sensitive personal information; and the right not to receive discriminatory treatment for exercising your privacy rights.

11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements or for other operational reasons. When we make changes, we will update the “Last Updated” date at the top of this page. For material changes, we will provide advance notice where appropriate, including by email to active newsletter subscribers and platform users, before the changes take effect. Your continued use of the Services after the effective date of any update constitutes your acceptance of the revised Privacy Policy.
